CENTRAL SERVICES (MEDICAL ATTENDANCE) RULES, 1944 [CS(MA) Rules] |
Introduction |
Medical attendance and treatment can be offered to central government personnel and their families under the Central Services (Medical Attendance) Rules, 1944. The primary goal of these regulations is to ensure that employees and their families have access to high-quality medical care and facilities. ‘District’ as per the definition of CS(MA) Rules means a district in which Govt. Servant fell ill. The Ministry of health and family welfare has the power to recognize any private hospitals for treatment of beneficiaries and their family members under CS (MA) Rules, 1944. Under CS(MA) Rules, a government servant desirous of availing of medical treatment outside India may make an application through the Ministry/Department under which the government servant is attached, to the Standing committee established under this rule in the form specified by the Standing Committee. |
Eligibility |
The CS(MA) Rules are applicable to all central government employees and their families. This includes employees working in All India Service, Central Services, Autonomous Bodies, Statutory Bodies. In case of re-employed pensioners who are entitled under CS (MA) Rules, 1944, both Pay and Pension are taken into consideration for calculating the entitlement |
Medical Facilities under CS(MA) Rules |
The CS(MA) Rules provide for medical facilities to central government employees and their families. The facilities include medical attendance, treatment, and hospitalisation, as well as some provisions of medicines and medical appliances. For mental diseases, a patient may be allowed to receive indoor treatment for a maximum period of Three Years. Testing of eyesight for glasses under CS(MA) Rules claim - Once in 3 years (Only for employee) The limit of 4 consultations within 10 days is applicable for attendance with a specialist/Medical Officer and will count from the date from which the Specialist/Other Medical Officer is consulted according to CS(MA) Rules. |
Reimbursement in CS(MA) Rules |
Where a Government servant is entitled, free of charge, to receive medical attendance, any amount paid by him on account of such medical attendance shall, on production of a certificate in writing by the authorised medical attendant in this behalf be reimbursed to him by the Central Government.The ceiling and the room facilities depends on the pay scale of the concerned government employee. Final claim of reimbursement of medical expenses, max period is 6 months. Medical advance shall be released within 10 Days from the receipt of the request. If advance is paid directly to the hospital, the final submitted bill should be submitted by the employee within 1 Month of discharge from hospital. Special nurse charges during in-patient treatment at the rate of Rs. 150 per shift for 12 hours. Reimbursement of charges special for Aya/Attendant is allowed at the rate of Rs. 75 per shift of 12 hours. |
Procedure for Medical Treatment |
The CS(MA) Rules specify the need for a medical certificate from an authorised medical practitioner, as well as prior approval from the competent authority for specific types of treatment. Due to non-availability of facility at a government hospital, a Medical Officer can send a Government servant and his family to a private clinic / laboratory for bacteriological or pathological examination with the consent of Director of health services When adequate numbers of Government doctors or their services are not available in various systems of medicine within a radius of 5 kms then Private registered medical practitioners would be appointed as AMA. |
Exclusions |
Any sort of expenses i.e. cosmetic surgery, infertility treatment and non allopathic treatment are not included. |
Authorised medical practitioner or Authorised Medical Attendant |
CS(MA) Rules elaborate the experience and qualifications that is required for a medical practitioner to be an authorised medical attendant (AMA). In respect of one single and continuous spell of illness, an AMA may provide medical attendance at his consulting room for a maximum period of 10 days . In respect of one single and continuous spell of illness, an AMA under Indian System of Medicine (AYUSH) may provide medical attendance for a maximum period of 40 Days. The combined total period of medical attendance by authorised medical attendant/specialist should in all jointly be limited to 10 Days. |
Scope of CS(MA) Rules |
Outpatient treatment, impatient treatment, hospitalisation, test, medicines and medical appliances are provided to the Government employee under these rules. Chronic disease and pre existing illness is also covered under CS(MA) Rules. |
Some Important Points to Remember |
1. When the medical reimbursement claim of an employee is rejected by the Controlling Officer and the reasons for rejection communicated to the claimant, the claimant may submit an appeal to the Central Government within 45 days from the date of receipt of the rejection order. 2. The medical prescription issued by an AMA, Govt Specialist diagnostic test/ investigation is valid for a single use within a period of Two Weeks from the date of prescription unless specified by them in the prescription. 3. Under which rule the servicing central government employees residing outside the CGHS covered areas? Ans : CS (MA ) Rules. 4. CS(MA) Rules do not apply to Retired Govt. Employees. 5. A male child of a Government Servant is allowed to receive medical attendance and treatment in a recognised women hospital till the age of Six years. 6. Group A officers of age of 40 years and above are covered for annual medical examination : 7. Where a government servant is entitled, free of charge to medical attendance by the AMA, any amount paid by him on account of such medical attendance shall, on production of a certificate in writing by AMA on his behalf, be reimbursed to him by the Central Government under the CS(MA) Rules, 1944. |
