CENTRAL CIVIL SERVICES (LEAVE) RULES, 1972- One Liners

1.     CCS (Leave) Rules came into effect on 1st June, 1972.

2.     Max Earned Leave can be availed in one spell: 180 days

3.    In case obtaining a leave admissibility report is likely to be delayed, authority competent to grant leave can issue provisional sanction of leave for a period not exceeding : 60 Days.

4.    Special allowance per month is paid to the women with disability for child care ? Ans: 3000/- p.m

5.    EL is generally not denied to the Govt. servant to decrease the accumulation of earned leave.

6.    EL can be combined with : Commuted leave, HPL, Maternity Leave.

7.  When a Government servant resigns from service, what is the maximum period of EL up to which encashment of leave salary is payable: Half of EL subject to a maximum of 150 days.

8.    EOL is granted when no other leave is admissible or is granted on request of govt. Employee.

9.    Maximum EOL that can be granted without Medical Certificate to a permanent Government servant : No limit

10.  What leave salary is payable to a Government servant who had been sanctioned EOL with Medical Certificate : No leave salary.

11.   What is the maximum period of leave on medical certificate that can be sanctioned to an Apprentice : One Month

12.  What will be the leave salary payable to an Apprentice, who has been granted leave on Medical Certificate : As in the case of HPL.

13.   What is the maximum period of leave which a Government Servant is permitted to take as leave preparatory to retirement : 300 Days.

14.   What is the kind of leave that cannot be included in leave preparatory to retirement granted to a Government servant : EOL.

15.   Leave of any kind should not exceed 5 years.

16.   If the medical authority is unable to say with certainty that the government servant will never again be fit for service, leave not exceeding 12 months in all may be granted.

17.   Combination of Study Leave with earned leave shall not generally involve a total absence of more than 28 months.

18.   Half Pay leaves – Max 180 days at a time.

19.   A Government servant who retired does not have any EL at his credit and wants to commute his HPL for encashment of leave salary of HPL, is it permissible ?: No commutation of HPL is not permissible. 

20.   Leave not due- max 360 days in entire service on Medical Certificate

21.   What leave salary is payable to a Government servant who is sanctioned  LND : As in the  case of HPL.

22.   Under what grounds LND is allowed to a temporary employee, who has put in more than one year of service : In case of self, chronic disease  viz., cancer.

23.   If an employee who availed LND returns to duty and resigns subsequently without earning the credit of HPL : He needs to refund the leave salary.

24.   Maximum period of study leave that can be availed by the Govt. servant is 24 months (Other than CHS officer)(12 months in one spell)

25.   Afternoon of the last day of the month in which an employee attains the age of superannuation is the date of retirement of a Government Servant.

26.   Maximum 730 days CCL can be availed by a female government servant in her entire service. In which 1st 365 days she will avail 100% of the Salary and for next 365 days she shall receive 80% of the salary.

27.   CCL is admissible if the child is below 18 years. CCL can be granted 3 times in a year not less than 5 leaves in a spell.(Single mothers can take CCL 6 times a year).

28.   A Single male government servant (Unmarried, Widower, Divorcee) can also avail CCL. 

29.   No age bar for CCL in case of disabled child. (Minimum 40% percentage of disability)

30.   CCL cannot be demanded as a matter of right.

31.   During the probation period CCL is granted on exceptional or extreme cases only.

32.   CCL may be combined with leave of the kind due and admissible except CL.

33.   If a Government servant is temporarily deputed to foreign service in India even then CCS(Leaves) Rules, 1972 shall be applicable to the Government servant.

34.   Time limit of continuous service after which a quasi-permanent employee is not confirmed : Three Years

35.   A government servant ceases to have any claim for leave to his credit, if he has been dismissed.

36.  If a Government servant claims for commutation of one kind of leave into another, he should apply for commutation, within a period of 30 days.

37.   A government servant cannot accept employment elsewhere while on leave except in the case of service as an Examiner.

38.   Leave account of an Gazetted Government servant is maintained by : Audit Officer

39.   No leave shall be granted if a government employee is under suspension.

40.   The leave sanctioning authority can waive the production of Medical Certificate in case of an application for leave on medical grounds, if the period of leave applied for is less than Three Days.

41.   Absence by a Government servant after expiry of leave shall be debited to his leave account as HPL to the extent such leave is due.

42.   If a Government Servant who has granted commuted leaves does not return to duty due to voluntary retirement : Difference of leave salary between commuted leave and HPL would be recovered.

43.   Encashment of EL & HPL to a Government servant/retired government servant came into effect : 1st Jan 2006

44.   Who is the Competent Authority for grant of cash equivalent of leave at the credit of Government : Authority to whom power of leave sanctioning have been granted

45.   Maximum number of Commuted leave that can be granted to a female employee without a medical certificate in continuation of her maternity leave : 60 days.

46.   What is the age limit of a child stipulated for grant of Child Adoption Leave : Below the age of one year.

47.   What is the maximum period up to which maternity leave can be granted to a female Government servant who is unmarried : 180 days.

48.   A female Government servant who has 4 surviving children requested for sanction of Maternity leave on account of abortion along with MC. Is she eligible for such a request : Eligible, not exceeding 45 days in entire service.

49.   A female Government servant applied for Maternity leave on account of threatened abortion. To what extent is she eligible: Not Eligible.

50.   What is the maximum period of interruption that can be waived for authorising the payment of study Allowance: 14 days.

51.   Leave encashment on resignation or quitting service is subjected to a maximum of 150 days but encashment of HPL is not admissible to such employees.

52.   An employee who is terminated by notice is eligible for both EL and HPL subject to a maximum of 300 days.

The leave sanctioning authority may refuse or revoke leave of any kind, but cannot alter the kind of leave due and applied for.

Casual leave is not recognized as leaves under these rules hence are not combined with any other kind of leave admissible under leaves rules
